1. About these Terms
These Terms of Sale and Website Use (the “Terms”) apply to:
- your use of the website parakeetrail.com and any related online storefront operated by us (the “Website”); and
- purchases made by consumers through the Website.
The Website and online store are operated by ΚΑΠΑΣΑΚΑΛΙΔΗΣ Π - ΜΟΥΝΤΖΟΥΡΗΣ Χ Ο.Ε., a general partnership established under Greek law, trading as Parakeet Rail (“Parakeet Rail”, “we”, “us” or “our”).
These Terms apply only to individuals purchasing primarily for purposes outside their trade, business, craft or profession (“consumers”). We do not accept business-to-business orders through the Website. If you wish to make a business purchase, please contact us so that separate commercial terms can be agreed.
By placing an order through the Website, you confirm that you have had the opportunity to read these Terms and the policies referred to in them before submitting the order. Simply browsing the Website does not, by itself, create a sales contract.
Nothing in these Terms limits or excludes any rights that cannot lawfully be limited or excluded under Greek or European Union consumer law.

3. Related policies
The following policies form part of the information governing purchases made through the Website:
The Refund Policy applies specifically to cancellations, withdrawal, returns and refunds. The Shipping Policy applies specifically to processing, delivery destinations, shipping methods, charges and estimated delivery times. These policies must be read together with these Terms. Mandatory consumer law will prevail over any inconsistent provision.
4. Eligibility and customer information
You may place an order if you are legally capable of entering into a binding contract. If you are under 18, you should place an order only with the involvement and permission of a parent or legal guardian where required by applicable law.
You must provide complete and accurate contact, billing, delivery and payment information. Please review your information before submitting an order. You can correct information during checkout. If you discover an error after placing an order, contact us as soon as possible. We will try to make the requested correction, but changes may no longer be possible after dispatch.
5. Products and product information
The main characteristics of each product are described on its product page. Please review the description, available options, dimensions or size information, materials, care instructions and any product-specific notices before ordering.
We take reasonable care to ensure that product descriptions, prices and images are accurate. Colours and appearance may vary slightly depending on lighting, photography and the display settings of your device. Such minor display differences do not affect your statutory rights if the goods do not conform to the contract.
Product availability may change. Placing a product in your cart does not reserve it. If a product becomes unavailable after you place an order, we will inform you without undue delay and will not charge you for that product, or will refund any amount already collected for it.
We may introduce products such as gift cards or products offered for preorder. Where we do so, any additional product-specific conditions, payment timing, estimated availability or delivery information will be shown clearly before purchase. Product-specific conditions cannot reduce mandatory consumer rights.
Products made to a customer's specifications or clearly personalised are not currently offered through the Website. If this changes, the relevant product page and checkout information will identify the product clearly and explain any legally applicable effect on the right of withdrawal before the order is placed.
6. Prices, taxes and delivery charges
Prices are displayed in euros (EUR). Prices displayed to consumers include applicable VAT unless the Website clearly states otherwise. Any delivery charge and other unavoidable cost applicable to an order will be displayed before the order is submitted.
Prices and promotions may change for future orders. A change will not affect an order that we have already accepted, except where the displayed price was an obvious error and applicable law permits the error to be corrected.
If we identify an obvious pricing or product-information error before accepting an order, we may reject the order and will promptly release or refund any amount collected. We will not charge a corrected or higher price without first informing you and obtaining your express agreement. If an error is identified after a contract has been formed, we will contact you and act in accordance with applicable law.
Promotional codes and discounts may be subject to additional conditions communicated when they are offered. Unless expressly stated otherwise, they cannot be exchanged for cash, combined with another promotion or applied after an order has been placed. Promotional conditions do not affect statutory consumer rights.
7. Payment
The payment methods available for your order are displayed at checkout. Payments are processed securely by Shopify and/or the payment provider associated with the method you select. The provider may apply its own terms and conduct fraud-prevention or payment-authorisation checks.
Depending on the payment method, payment may be authorised or collected when you submit the order. Payment authorisation or collection does not, by itself, mean that we have accepted the order. If we do not accept the order, any authorisation will be released or any amount collected will be refunded without undue delay using the original payment method, unless another method is expressly agreed.
You are responsible for ensuring that you are authorised to use the selected payment method and that sufficient funds or credit are available.
8. Placing an order and formation of the contract
The checkout process allows you to review the products, quantities, prices, delivery method, delivery charge and your contact and address details before submitting the order. By activating the final order button, you submit an order with an obligation to pay.
Your order is an offer to purchase the products listed in it. After submission, you will normally receive an automatic email acknowledging that we have received the order. This acknowledgement is not acceptance of the order.
A binding sales contract is formed when we send you an express order-acceptance confirmation or a shipping confirmation, whichever occurs first. The contract covers only the products identified in that confirmation.
We may decline an order before acceptance for an objective and legitimate reason, including:
- a product being unavailable;
- payment not being authorised;
- a delivery address being outside the destinations we serve;
- an obvious pricing or product-information error;
- quantities indicating a commercial or resale purchase rather than a consumer purchase; or
- reasonable evidence of fraud, unlawful activity or misuse of the Website.
If we decline an order, we will inform you without undue delay and will release or refund any payment authorisation or amount collected. We will not reject an order for an unlawfully discriminatory reason.
You will receive the order information electronically. Please retain the order confirmation, these Terms and the applicable policies for your records.
9. Preorders
If a product is offered for preorder, it will be clearly identified as such before purchase. The product page or checkout will state the estimated dispatch or availability period and, where relevant, when payment will be authorised or collected.
Estimated preorder dates may change for legitimate production, supply or transport reasons. If a material delay occurs, we will inform you and provide any cancellation or refund option required by applicable law. Unless a lawful exception has been disclosed before purchase, preorder products retain the statutory withdrawal and conformity rights described in these Terms and the Refund Policy.
10. Delivery
We deliver to the destinations and by the methods described in our Shipping Policy. The available method, charge and estimated delivery time for your address will be displayed at checkout before payment.
Processing and delivery periods are estimates unless we expressly agree a guaranteed date. We will inform you of a significant delay that comes to our attention. Your statutory rights concerning delayed or failed delivery remain unaffected.
The risk of accidental loss of or damage to the goods passes to you when you, or a third party designated by you other than the carrier, obtains physical possession of the goods. If you independently appoint a carrier that was not offered by us, risk may pass when the goods are delivered to that carrier, as provided by applicable law.
If a shipment is lost or damaged before risk passes to you, we remain responsible for providing the remedy required by applicable law.
11. Right of withdrawal, cancellations, returns and refunds
Consumers generally have the right to withdraw from an eligible online purchase without giving a reason within 14 calendar days after receiving the goods. The conditions, procedure, return-cost rules, refund timing, legally permitted exceptions and model withdrawal form are set out in our Refund Policy.
You may notify us of your decision to withdraw:
- through the electronic withdrawal, cancellation or return function made available through your customer account or order-status experience; or
- by sending a clear statement to info@parakeetrail.com.
During the applicable withdrawal period, the electronic withdrawal function will be clearly identifiable and easily accessible through the relevant customer account or order interface. It will allow you to identify yourself and the relevant order or contract, confirm the withdrawal request, and receive an acknowledgement on a durable medium, such as email, without undue delay. The acknowledgement will include the content of the request and the date and time when it was submitted.
The electronic function is an additional method and does not prevent you from exercising the right of withdrawal by email or by another legally valid unequivocal statement.
The statutory right of withdrawal is separate from your rights when goods are incorrect, damaged, defective or otherwise non-conforming.
12. Legal guarantee and non-conforming goods
Goods supplied to consumers must conform to the sales contract. Eligible goods benefit from the legal guarantee of conformity provided by applicable Greek and European Union law, including the applicable minimum two-year protection. This legal guarantee is provided without additional charge and is separate from any voluntary commercial warranty that may be offered.
If goods are defective, do not match their description, lack agreed characteristics or are otherwise non-conforming, please contact us at info@parakeetrail.com with your order number and a description of the issue. Photographs may help us assess the issue but will not be required where they are unnecessary or disproportionate.
Depending on the circumstances and applicable law, remedies may include repair or replacement without charge, or, where the legal conditions are met, an appropriate price reduction or termination of the sales contract and refund. Remedies will be provided within a reasonable time and without significant inconvenience to you. We will cover necessary costs, including shipping, where required by law.
Nothing in these Terms or our Refund Policy limits these rights.
13. Customer accounts
You may be able to place orders or manage purchases through a customer account. You are responsible for keeping account credentials confidential and for taking reasonable steps to prevent unauthorised access. Please notify us promptly if you believe your account has been compromised.
We may temporarily restrict or suspend access to an account where reasonably necessary to address a security incident, fraud, unlawful activity or serious misuse. Any measure will be proportionate to the issue and will not remove rights relating to existing orders, refunds, personal data or other mandatory consumer protections.
14. Reviews and other customer content
If the Website allows reviews, comments, photographs or other customer content, you must submit only content that you are entitled to provide and that is not unlawful, misleading, abusive, discriminatory, defamatory, infringing, fraudulent or malicious.
You retain ownership of your content. By submitting content for publication, you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, translate where appropriate and display that content solely for operating, promoting and improving the Website and our products. The licence lasts only for as long as reasonably necessary for those purposes, subject to legal recordkeeping requirements.
We may decline, moderate or remove content for a legitimate reason, including illegality, infringement, spam, undisclosed commercial promotion, irrelevance or violation of these Terms. We will not remove a genuine review solely because it is negative. Where we make claims about review verification, we will describe the verification method accurately.
15. Acceptable use of the Website
You must not use the Website to:
- commit or facilitate fraud or another unlawful act;
- introduce malware or interfere with the security or proper operation of the Website;
- gain unauthorised access to accounts, systems or data;
- infringe intellectual-property, privacy or other legal rights;
- submit false information intended to deceive us or another person;
- harass, threaten or unlawfully discriminate against another person; or
- use automated extraction or scraping in a way that violates applicable law or materially disrupts the Website.
We may take proportionate technical or account-level measures to prevent or respond to such conduct. This section does not restrict rights granted by mandatory law.
16. Intellectual property
Unless otherwise indicated, the Website and its original content—including text, artwork, graphics, photographs, logos, product presentation and software elements—are owned by or licensed to Parakeet Rail and are protected by applicable intellectual-property law.
You may access and use the Website for personal, non-commercial shopping and information purposes. You may not reproduce, commercially exploit, distribute or modify protected content without permission, except where applicable law allows it.
References to third-party trademarks or content remain the property of their respective owners.
17. Third-party services and links
The Website may contain links to independent third-party websites or services. We do not control independent third-party content and are not responsible for it merely because a link is provided. You should review the terms and privacy information of an independent third party before using its service.
This section does not limit any responsibility we have under applicable law for service providers, payment providers, carriers or other parties we use to perform our obligations under a sales contract.
18. Our responsibility
We are responsible for losses that are a reasonably foreseeable consequence of our breach of these Terms or failure to use reasonable care and skill, subject to applicable law.
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- wilful misconduct or gross negligence where liability cannot lawfully be limited;
- breach of mandatory consumer-protection or product-conformity obligations; or
- any other liability that applicable law does not permit us to exclude or limit.
Because the Website is intended for consumer purchases, we are not responsible under these consumer Terms for business losses, loss of business opportunity or loss of commercial profit arising from use of products for business purposes. This does not affect liability that cannot lawfully be excluded.
We do not guarantee that the Website will always be available without interruption. We may perform maintenance or respond to security and technical incidents. Website unavailability does not affect rights arising from an existing sales contract.
19. Events outside our reasonable control
We are not responsible for a delay caused by an event genuinely outside our reasonable control to the extent that the event prevents or delays performance despite reasonable mitigation efforts. Examples may include severe weather, natural disasters, widespread transport disruption, governmental measures, major network outages or industrial action not limited to our own workforce.
We will inform affected customers when reasonably possible and take reasonable steps to reduce the delay. This section does not remove any right to cancel, withdraw, receive delivery within an additional appropriate period or obtain a refund where applicable law provides that right.

Please include your order number, where applicable, and a clear description of the issue. We will review the complaint and respond within a reasonable time.
Where required by applicable law, we will provide information about any competent alternative dispute resolution entity that may be able to consider the dispute and the procedure for accessing it. Participation in a particular alternative dispute resolution procedure will be governed by applicable law and any commitment expressly made by us. Nothing in this section prevents you from contacting a competent consumer-protection authority or bringing a claim before a competent court.
The former European Commission Online Dispute Resolution platform has been discontinued and is not incorporated into these Terms.
21. Governing law and jurisdiction
These Terms and sales contracts concluded through the Website are governed by Greek law.
If you are a consumer resident in another European Union or European Economic Area country, this choice of law does not deprive you of mandatory consumer protections that apply under the law of your country of habitual residence.
Any dispute may be brought before the courts that have jurisdiction under applicable consumer and private-international-law rules. These Terms do not require a consumer to bring proceedings exclusively before the courts of Athens or waive a right to bring proceedings before another court that is competent under applicable law.
22. Changes to these Terms
We may update these Terms for future use of the Website and future orders, for example to reflect legal, operational or technical changes. The current version and its update date will be published on this page.
Changes do not retroactively alter a sales contract already formed unless the change is required by law or is expressly agreed with you in a legally valid manner. The version made available to you when you place an order will govern that order, subject to mandatory law.
Where a change materially affects an ongoing customer account feature or another continuing relationship, we will provide any notice required by applicable law.
23. Severability and no waiver
If a provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent legally possible. An invalid provision will not be interpreted or replaced in a way that removes or reduces mandatory consumer rights.
If we do not immediately enforce a provision, this does not mean that we waive the right to enforce it later, subject to applicable limitation periods and consumer law.
24. Language versions
These Terms may be made available in Greek and English. Both versions are intended to have the same meaning. Any inconsistency will be resolved in a manner that preserves mandatory consumer rights and the requirement that consumer terms be clear and understandable.
Where a contract is concluded through the Greek-language version of the Website, the Greek version of these Terms will be used as the primary reference, without limiting any protection available under applicable law.
